Law Offices of Mathys & Schneid Obtains $7.25 Million Settlement In Medical Malpractice Lawsuit

The Law Offices of Mathys & Schneid recently secured a $7.25 million settlement on behalf of a client whose malaria went undiagnosed by a Cook County, Illinois, hospital and emergency room doctor. The settlement, which was obtained shortly after the plaintiff gave her deposition testimony, is one of the largest of its kind in the country.

The plaintiff, a 29-year-old female, returned to Chicago on August 29, 2013, following a trip to West Africa. Shortly after her return, she went to the defendant hospital for emergency room treatment after developing a fever that persisted for several days. The emergency room doctor suspected malaria, but discharged the plaintiff within three hours, before the malaria tests were completed. Had the tests been completed that same day, as required by the hospital’s own written policies and procedures, they would have shown that plaintiff had treatable, early-stage malaria.

After being sent home from the emergency room, plaintiff’s condition dramatically worsened. The next day she was taken to a different Chicago-area hospital, where she was diagnosed and treated for severe malaria. Unfortunately, the disease had progressed to such a stage she sustained severe brain damage and irreversible kidney damage.

During litigation, Mark W. Mathys and Mark T. Schneid of the Law Offices of Mathys & Schneid established that plaintiff’s malaria was treatable at the time she presented herself to the defendants for care. Had they properly diagnosed and treated her condition, plaintiff would not have developed brain or kidney damage. Due to their failure to properly diagnose and treat plaintiff, she requires kidney dialysis, medications and, eventually, a kidney transplant.
