DISCOVERY RULE PROVIDES NEW AVENUE FOR JUSTICE FOR VICTIMS IN WRONGFUL DEATH ACT AND SURVIVAL ACT CASES

The Illinois Supreme Court has now provided a new avenue for victims in wrongful death act and survival act cases: the discovery rule. Pursuant to 735 ILCS 5/13-212(a), the discovery rule establishes that, within a four-year statute of repose, any claim of malpractice against a physician or hospital must be filed within two years of the date on which the claimant knew or through the use of reasonable diligence should have known of the existence of the injury or death for which damages have been sought. In Moon v. Rhode, the Illinois Supreme Court found that it was an issue of fact in wrongful death and survival actions predicated upon medical malpractice as to when the individual knew of the injury and its negligent cause. The discovery rule can now extend the wrongful death act and survival act statute of limitations beyond the two-year anniversary of death.

Three-Car Crash in Park Ridge Kills 1, Injures 2 Others

A major car crash in Park Ridge, Illinois, on February 11, 2016, resulted in the death of 1 driver and injury to 2 others. The crash occurred at the intersection of Dee and Talcott Roads, near Maine South High School. A Des Plaines woman, 81, was southbound on Dee Road and making a left turn onto Talcott Road when a Chicago woman, 43, headed northbound on Dee Road, crashed into her. The Chicago woman then crashed into another car on westbound Talcott Road, injuring a Skokie woman, 47.

Illinois auto collision claims one life in Tazewell County

A crash in Tazewell County, Illinois, has left one person dead and two persons injured. The incident happened at approximately 6:45 p.m. on a recent Wednesday. According to the County Sheriff, a 70-year-old man crossed into opposing traffic and collided with another vehicle that contained three people.

Lombard Man Killed in Car-Bicycle Crash

A Lombard man was struck and killed by a vehicle while riding his bicycle at the intersection of Route 83 and 16th Street in Oak Brook, Illinois on November 8, 2015. Police say the man entered the intersection and was struck the vehicle, driven by a Westmont man in his 50s.

Woman tragically dies in dialysis facility after ambulance failed to transport her to hospital

A Kurtz ambulance service failed to pick up a patient according to their scheduled pickup, possibly contributing to her untimely death. A 71 year old woman was scheduled to be transported from 1051 Essington Road to a local hospital. Her transportation never arrived and she was left inside the building after hours until firefighters discovered her sitting in her wheelchair. A second phone call to the ambulance company was never made.

Bensenville Woman Killed in Hit-and-Run

A Bensenville woman was struck by a pickup truck while crossing the sidewalk on the 1000 block of West Irving Park Road in Bensenville, Illinois on October 23, 2015. Police say the driver of the truck was exiting the Dunkin' Donuts parking lot when the driver struck the woman. The truck then continued eastbound on Irving Park Road without stopping.
