Romeoville Man Struck, Killed By Semi-Truck

On May 7, 2018, a Romeoville man was struck and killed on Route 53 near Greenwood Avenue in Romeoville, Illinois. Police say the crash occurred around 3:00 p.m. on Monday when the driver of the semi-truck, a 53 year-old man from Markham, struck the pedestrian as he attempted to cross the street.

Kane County Crash Kills 1, Injures 2

On May 6, 2018, around 11:30 p.m., two cars crashed head-on at Route 47 near Beith Road in Campton Township, Illinois. The Kane County Sheriff's Office reports that Linda Clark was southbound on Route 47, in a Honda Civic, when she crossed over the center dividing line and crashed into a northbound Toyota Highlander.

Fatal Single-Car Crash in Bartlett Kills Two

On April 8, 2018, in Bartlett, Illinois, two people were killed when their car left the road and struck a utility pole. Authorities say that the driver of the car, Darion Garner, age 25, was traveling with six other people when he lost control of his 2005 Ford Escape near the intersection of Lake Street and Route 20, near the Route 59 overpass.

Uninsured Drunk Driver Causes Fatal Crash

On March 11, 2018, Timothy McGuire, 37, caused a fatal two-car collision near 167th Street and 80th Avenue in Tinley Park, Illinois at 9:50 p.m. Tinley Park Police have not released exact details of the crash, but did report that McGuire was uninsured and hit another vehicle while intoxicated. As a result of the crash, a passenger in the second car, Armida Reyes, 79, of Tinley Park, was killed. Police also report that McGuire and two other occupants were injured and transported to local hospitals.

Drunk Driver Causes Fatal Four-Car Crash

On January 20, 2018, Brian Larson, 36, caused a four-car collision on I-55 just south of I-355 near Bolingbrook, Illinois at 1:52 a.m. Illinois State Police have not released the details of the crash, but did report that Larson was injured and later charged with driving under the influence. As a result of the crash, Carlos Ortiz, 31, Plainfield, was killed.

I-88 Car Crash Leaves One Dead, Injures Another

On December 15, 2017, 4 vehicles were involved in a crash on eastbound I-88 just west of Route 47, near Sugar Grove. Illinois State Police determined that Samuel Gradman, a 19 year-old Northbrook man driving a 2003 Infiniti passenger car, failed to yield to construction equipment on the highway, causing him to strike a Ford pickup truck before losing control and crashing into two parked tollway maintenance trucks.

45 Year Old Woodridge Woman Struck and Killed on Halloween

On October 31, 2017, a 45 year-old Woodridge woman was hit by a car at Route 53 and High Tail Drive in Woodridge. The victim, Cindy Higgins, was found injured at the intersection by police and transported to Edward Hospital in Naperville where she died from her injuries.

DISCOVERY RULE PROVIDES NEW AVENUE FOR JUSTICE FOR VICTIMS IN WRONGFUL DEATH ACT AND SURVIVAL ACT CASES

The Illinois Supreme Court has now provided a new avenue for victims in wrongful death act and survival act cases: the discovery rule. Pursuant to 735 ILCS 5/13-212(a), the discovery rule establishes that, within a four-year statute of repose, any claim of malpractice against a physician or hospital must be filed within two years of the date on which the claimant knew or through the use of reasonable diligence should have known of the existence of the injury or death for which damages have been sought. In Moon v. Rhode, the Illinois Supreme Court found that it was an issue of fact in wrongful death and survival actions predicated upon medical malpractice as to when the individual knew of the injury and its negligent cause. The discovery rule can now extend the wrongful death act and survival act statute of limitations beyond the two-year anniversary of death.
