Law Offices of Mathys & Schneid recently recovered a nearly $39 million settlement for a victim of a motorcycle accident in Illinois.
Our client, a 52-year-old man, was riding his motorcycle from Bolingbrook, IL, to Galena, IL, on June 1, 2019, when an improperly installed rear tire separated from the rim, throwing him off the vehicle and causing a serious traumatic brain injury.
When the client reached highway speeds on his motorcycle, his rear tire went flat, and the motorcycle began to weave. Following proper safety procedure, our client slowed down and began moving toward a safe place to stop on the side of the road.
Before he could get there, the rear tire separated from the rim, wedged itself in the motorcycle’s frame, and launched him onto the road. The impact caused a complex subdural hematoma and subarachnoid hemorrhage.
Investigations proved that a national maintenance company – one of three defendants in the case – installed an improper tire with a valve stem that was too long on the rear wheel of the motorcycle.
This negligence caused the wreck that left our client with life-altering injuries.
Attorney Mark T. Schneid said of the case, “Changing a motorcycle tire and air valve stem is an easy job to do for a certified motorcycle mechanic, but if a mechanic carelessly disregards basic safety warnings from the motorcycle and tire manufacturers and just installs the cheapest aftermarket parts available, somebody will get killed or traumatically injured.”
The Law Offices of Mathys & Schneid filed a case against the maintenance company that put the tires on the motorcycle, the national company that sold the motorcycle to a local dealer, and the local dealer that sold the motorcycle to our client.
They called a team of experts, including engineers, accident reconstructionists, and motorcycle professionals, to prove that the accident was caused by the bad tire.
On January 5, 2023, a Cook County judge approved a settlement of $38,950,000 for our client.
