Mathys & Schneid recently filed a lawsuit in Kendall County on behalf of a passenger who was injured in a single-car crash that occurred on August 10, 2017. Our client was one of four passengers in a car when the driver lost control of the vehicle and struck a tree on Douglas Road in Oswego. The lawsuit alleges that the driver of the car drove too fast for conditions, failed to reduce speed to avoid a crash, failed to keep a safe and proper lookout, and failed to keep the car on the road. The lawsuit also alleges that the driver acted willfully and wantonly by driving under the influence.
As a result of the crash, our client received multiple fractures to the collarbone, shoulder blade, and ribs, an umbilical hernia, a concussion, and several lacerations to the forearms and elbows. It is reported that the other passengers were severely injured as well.
Drivers are responsible to their passengers for injuries caused by their negligent driving. If you were injured as a passenger, it’s important to contact a personal injury attorney immediately. Your attorney will be able to secure important crash data, and also explore all options for your recovery. Oftentimes, your attorney will be able to pursue a claim against the driver and also against your own insurance company under uninsured/underinsured motorist coverage, even if your car wasn’t involved in the crash.
