Immediate steps to take after you are attacked by a dog

If you were attacked by a dog, the first thing you need to do is call the police and seek immediate medical attention. The police and animal control are in a position to investigate the attack and safely remove the dog if it is likely to cause further harm to others. Obtain a copy of the report and the information of the dog owner. Also, take photographs of the dog (if possible) and of your injuries to preserve any bite marks or scarring which may occur.

Claims against an owner for a dog attack are made through homeowners insurance, dog owner insurance, or renter insurance. In Illinois, dog bite owners are responsible for all damages to the victim who is bitten by their dog. Illinois law states (510 ILCS 5/16 Sec. 16):

"If a dog or other animal, without provocation, attacks, attempts to attack, or injures any person who is peaceably conducting himself or herself in any place where he or she may lawfully be, the owner of such dog or other animal is liable in civil damages to such person for the full amount of the injury proximately caused thereby."

To make a claim against a dog owner, you need to know the contact information of the owner. Also, it is important to be able to identify the dog that attacked you. A claim against a dog owner cannot be made if you were in a place you were not lawfully entitled to be (you were trespassing). Also, there are some further exceptions that prohibit you from making a successful dog bite claim, including provoking the dog.
