How is my disability settlement calculated after a work injury?

If you have sustained a work-related injury and have lost the ability to do the same things before your work injury, you may be entitled to permanent partial disability benefits. Illinois law sets the number of weeks for specific body parts. You calculate the benefits which you would be entitled based on the severity of the specific body part using the scheduled injury table provided by the Illinois Workers' Compensation Commission.

Section 8(e) of the Illinois Workers' Compensation Act provides the following table for scheduled injuries which occur after February 1, 2006. Below is a general summary of that table:

1. Thumb - 76 weeks

2. First, or index finger - 43 weeks

3. Second, or middle finger - 38 weeks

4. Third, or ring finger - 27 weeks

5. Fourth, or little finger - 22 weeks

6. Great toe - 38 weeks

7. Each toe other than great toe - 13 weeks

8. Hand - 205 weeks

9. Arm - 253 weeks

10. Foot - 167 weeks

11. Leg - 215 weeks

12. Loss of sight in one eye - 162 weeks

13. Loss of one eye - 173 weeks

14. Loss of one testicle - 54 weeks

15. Loss of both testicles - 162 weeks

16. Man as a whole - 500 weeks (all other injuries not defined within the Section 8(e) schedule)

The schedule of injuries is the maximum amount of recovery you would be entitled to for a complete loss of that body part. Your benefits are calculated on the extent of the disability to that body part using your permanent partial disability rate, which is calculated at 60% of your average weekly wages prior to your injury. Of course, you should consult with an experienced workers' compensation attorney to completely review your claim, as well as the applicable scheduled loss.
