How Social Media Will Decrease the Value of Your Personal Injury Case

It's safe to say that everyone uses some form of social media at least once a day. Thanks to Facebook, Twitter, and Instagram, you can share something easily with multiple people in a very short amount of time. However, when you become a personal injury victim, it is crucial that you stop posting information about yourself on social media.

Anything posted on social media has the potential to be used against you during your personal injury case. The at-fault party's insurance company knows that people use Facebook or Twitter to diary life events, so it will investigate your accounts for any information that could call any aspect of your claim into doubt. Typically, the insurance company will look for anything related to your injuries and your claimed disabilities.

For example, assume you were rear-ended at a stoplight and you claim you've suffered a serious back injury that's keeping you from all physical activities. It is likely that the insurer is going to investigate your social media accounts to see if you've posted anything related to your pain. If the insurer finds a photo of you shoveling snow after claiming a debilitating lower back injury, you can expect the value of your claim to decrease. If your claim went to trial, your credibility with the judge and jury would be damaged when the defense uses the photo during cross-examination. You will have to explain how, even though you're seriously hurt and can't partake in any physical activity, you're still able to shovel your driveway. Because your credibility is crucial to your recovery, you do not want to have to explain your social media content in court.

The most common-sense approach is to simply avoid posting anything describing your injuries, how you got hurt, or how you feel. We've all had times where we woke up one day feeling great and woken up the following day hurting again. Don't let something you posted during a good day be the reason your entire case falls apart.
