Mark W. Mathys of Law Offices of Mathys & Schneid recently obtained a $650,000 settlement for a family of a man who was killed in a drunk driving accident in DuPage County.
On November 13, 2012, our deceased client, a 29 year-old man, was a passenger in a car driven by an intoxicated driver westbound on Interstate 88 in Oak Brook. At that time, the drunk driver drove the car off the road and into the guardrail where he lost control of the vehicle, drove into a ditch and flipped the car several times before it came to a rest on its side. Our client was ejected during the collision landing 200 feet away in the middle of westbound I-88. He was later pronounced dead at a local hospital due to his injuries. Blood tests later revealed that the driver had a blood alcohol level of .291, almost 4 times the legal limit.
At first, the driver attempted to escape responsibility for this collision by claiming that our client was driving the car, not him. To disprove this, Mathys & Schneid obtained blood DNA evidence results from the driver’s airbag and driver’s compartment proving that the defendant was, in fact, the driver in this collision that caused our client’s wrongful death. The driver’s insurance company then attempted to blame our client claiming that he assumed the risk of injury and death by getting in a car with an intoxicated driver.
None of these tactics worked. Mathys & Schneid aggressively prosecuted the case, finally obtaining justice and closure for this family devastated by this tragedy when the case settled shortly before a trial was to be set in DuPage County.
