What happens if I am unable to return to work after a work-related injury?

Suffering from a catastrophic injury leaving you unable to work is a life-changing event that has significant effects on you and your family. Illinois workers who suffer from a work-related injury leaving them permanently and totally disabled may be eligible to receive benefits for life. Filing a successful claim for Permanent Total Disability (PTD) entitles an injured worker to receive 2/3 of their average weekly wages for their average life expectancy, according to the Life Tables. Payments are subject to maximums and minimums depending on the date of the accident.

There are a few general ways you can make a claim for PTD. First, a claim for PTD can be made for a complete loss of two body parts including hands, eyes, arms, legs or feet. Second, are claims made by workers who are so limited in their ability to return to work, no stable labor market exists for a person of a similar age, experience, training, restrictions and education. This is known as "odd lot" PTD. Generally, the injured employee will need to make a diligent job search and obtain vocational rehabilitation to prove their claims. Finally, if your treating physicians established your incapacity is so significant and you are adjudicated as medically permanently totally disabled that you are unable to work.

In addition to lifetime wages, you may be entitled to future medical care for your work-related injuries. Establishing a PTD claim is a difficult and long road to recover these benefits. Workers' compensation insurance companies are reluctant to settle these type of claims, even after your treating physicians have established your permanent impairment.
