Illinois property owners need to stop accidents from happening

When an accident happens, people in Illinois are sometimes too quick to say that it was no one's fault; they think that an accident is simply something unfortunate that happened that no one could have prevented. However, from a legal perspective, this is simply not always true. Some accidents can be prevented, and property owners may have an obligation to do so.

How to Get Medical Treatment After an Accident if you Don't Have Health Insurance or Money

If you've been injured in a car accident and have no money or health insurance, you might wonder who is going to pay for all your medical bills.  You may wonder why the person who caused the accident (or their insurance company) won't pay for treatment right away.

Why do commercial trucks crash in Illinois?

Of course, trucks in Illinois can crash for many different reasons, so it is impossible to pin down why all accidents occur. However, it is worthwhile to look at some of the main reasons for accidents to understand both how these crashes take place and what rights you may have to financial compensation if you are involved in a truck accident.

Should I give a recorded statement to the insurance company after a car accident?

If you were injured in a car accident, you should definitely not give any kind of verbal statement to the at-fault driver's insurance company. Anything you say to the other insurance company will be used against you in your case.

Is my employer paying me the right amount while I'm off work?

Temporary total disability benefits (TTD) are a type of benefits that an injured employee receives during the period which the employee is unable to work. The employee can either be off work, as indicated by his or her doctor, or if the employee is placed on light-duty restrictions and the employer is unable to accommodate those restrictions.

Truck driving in wrong lane crashes in Illinois, killing 2 nuns

A pickup truck in Illinois drove in the wrong lane on the way through an intersection, slamming into 11 cars that were stopped at a red light. A still image of the truck just before the crash shows it coming directly toward the vehicles. Among those who were killed in the accident were two nuns in one of the first vehicles to be hit.

I was hurt at work; do I have a workers' compensation claim?

In Illinois, the employee bears the burden to show that he or she sustained accidental injuries arising out of and in the course of the employment. The employee must prove the employee was at the workplace and doing what is reasonably expected at the time of the incident. This is generally not in dispute if the employee was working their normal shift while they were injured.

How much is my workers' compensation claim worth?

While the value of your claim primarily depends upon the nature of your injuries, the wages you earned prior to a work accident are a major factor in determining your workers' compensation benefits. Sometimes clients have had friends or family members with a similar back injury, course of treatment and prognosis but ask why that friend or family member received a larger settlement. In that scenario, if two people with similar injuries and prognosis, but one is making double the wages, it is likely his or her settlement will be twice as much as the other person. That is because your Average Weekly Wage (AWW) is a large determinant of your workers' compensation benefits.

Holding doctors to a high standard in Illinois

One of the most important things to know about medical malpractice in Illinois is that it in no way needs to be intentional. The doctor may attempt to be as careful as possible, and he or she may take a few steps to do so, but negligence and accidents can still lead to malpractice claims. If a doctor forgets an important detail -- such as what types of medicine you are allergic to -- it can have a drastic impact on your life and your health, even though the doctor did not mean any harm.
