How long do I have to file a workers' compensation claim?

Under Illinois workers' compensation law, there is a time limit to file a workers' compensation claim. The deadline to file a claim is called the Statute of Limitations. In Illinois, the Statute of Limitations for workers' compensation claims is three years from the date of the accident or two years from the date of the last benefits received. In addition to the time period to file a claim, you must notify your employer within 45 days of the work accident. If you were injured on the job and continued to seek medical treatment paid by the employer or its insurance company beyond the three year limitation, the deadline to file your claim may be extended by two years from the date of the last medical benefits received. Additionally, if you received benefits in the form of workers' compensation payments, the deadline to file your claim may also be extended by two years from the date of the last payments received.

Sometimes, injuries at work are not caused by a specific event, such as lifting a heavy object. If your injuries were not caused by a specific event, the date of injury would be the point in time which a reasonable person would be aware of the relationship between the injury and the employment. Typically, these cases are the result from overuse or repetitive use of a particular body part.
