Under Illinois workers' compensation law, there is a time limit to file a workers' compensation claim. The deadline to file a claim is called the Statute of Limitations. In Illinois, the Statute of Limitations for workers' compensation claims is three years from the date of the accident or two years from the date of the last benefits received. In addition to the time period to file a claim, you must notify your employer within 45 days of the work accident.
