$1,700,000 Settlement of Cook County Infant Wrongful Death Case

Law Offices of Mathys & Schneid recently obtained a $1,700,000 Dangerous Drugs settlement for a family whose 2-month old son died due to side effects of a prescription medication that was prescribed by his pediatrician.

The infant’s parents brought him to the pediatrician’s office with complaints of fever and minor abdominal issues.  The pediatrician admitted the infant to a suburban hospital for three days and then discharged him with a prescription for medication to be taken at home. The parents took the written prescription to a nearby retail pharmacy where the pharmacist dispensed a version of the prescription medication that contained different active ingredients than the actual prescribed medication.  The parents gave the infant the dispensed prescription medication as instructed for three days.  On the fourth day, the mom and dad found the infant unresponsive in his crib.

The lawsuit alleged that the prescription medication was never proven to be safe or effective, actually caused very dangerous side-effects, and should never have been prescribed by the doctor in this situation.  The lawsuit alleged that the dispensed prescription medication was never approved by the U.S. Food and Drug Administration (FDA) for sale in the U.S. and was dangerous and defective.  The lawsuit also alleged that the retail pharmacy dispensed the wrong prescription medication to the parents.  These combined actions were alleged to have caused the infant’s death.  All defendants denied and continue to deny any wrongdoing.
