Failure to diagnose risk factors leads to birth control stroke

An Illinois woman who suffered a serious medical event after taking the birth control pill Yasmin has been awarded $14 million by a civil jury. The woman, age 37, suffered a stroke less than two weeks after she began taking the medication in 2007. She is paralyzed on her left side and has difficulty communicating. Further, the woman's husband must stay home with her round-the-clock, so he is now unable to work.

This case is just the most recent in a string of medical malpractice and failure to diagnose suits that have targeted Yasmin. This woman's physician failed to identify risk factors that could have led to the woman suffering from a cardiac event. Instead of prescribing Yasmin, for example, the man could have chosen another hormonal method, such as a progesterone-only pill.

A hospital had already settled with the woman for $2.5 million in connection with the incident. This recent personal injury suit was filed against the woman's prescribing physician. The woman began taking the pill in 2007 after suffering from irregular bleeding. She was on the pill for just 13 days when she suffered the severe stroke. News reporters were unable to reach the prescribing physician for comment about this massive ruling.

Physicians who make doctor errors should be held responsible for their bad decision-making. There are many specific physical risks that come along with taking even some of the mildest prescription medication. No patient should ever have to worry about suffering a major medical event that is caused by a physician's failure to diagnose underlying risk factors. Victims who have been harmed because of hospital negligence or medical mistakes may be entitled to financial compensation.
