Law Offices of Mathys & Schneid recently settled a Will County car accident case involving neck and back injuries from a rear end crash in December 2011. The case settled for $100,000, which was limits of the other person’s insurance policy.
Our 52 year-old client was driving his car on Route 59 near Hassert Boulevard in Naperville when his car was struck from behind by another car. Our client had some minimal painless arthritis in his neck before the crash, but the crash aggravated his preexisting condition and triggered severe back injuries. Shortly after the crash our client began to experience severe neck and back pain with pain radiating down into his right shoulder, forearm and fingers. This was a sign of a serious pinched nerve in his neck. After trying to get relief from medication and physical therapy, our client was forced to get a neck fusion surgery by a leading local orthopedic surgeon.
Despite clear evidence of fault on the other driver and a serious injury with very high medical bills for our client, the other person’s insurance company refused to accept responsibility. Once we filed the lawsuit in Will County and obtained the deposition testimony of the orthopedic surgeon who performed the operation, we were able to force the insurance company to accept responsibility and offer the $100,000 settlement.
Our client’s underinsured motorist coverage (UIM) was explored as a possible source of additional recovery for him.
