Law Offices of Mathys & Schneid recently settled a DuPage County car accident case involving a minor hand fracture, head laceration and a concussion. The case settled well before trial for $95,000. The car accident happened when the other driver failed to obey a stop sign and crashed into the driver’s side of our client’s car.
Our client sustained a broken hand, concussion and a scalp laceration. After the crash she had difficulty with memory and concentration and her doctors suspected that she had post-concussion syndrome. After taking the defendant’s deposition, we filed a motion to have the court find that the defendant was negligent even before the jury trial started. This strategy would prevent the defendant from trying to argue that he didn’t cause the crash at trial and would let the jury focus only on the severity of our client’s harms and losses. Once our client’s team of neurologists and a neuropsychologist ruled out any permanent brain damage or problems from the crash, we were able to assess the case value and demand settlement. Our client was very pleased that we were able to obtain the $95,000 settlement without her having to go to trial.
