Widow files suit for fatal truck accident on Illinois tollway

The wife of a man who perished in a fiery collision on an Illinois tollway in January plans to pursue legal action against the truck driver who caused the accident. The woman is also suing the employer of the man who caused the truck accident. Attorneys for the woman and her family say that something has to be done to stop reckless truck drivers who disobey mandates designed to prevent truck driver fatigue.

Authorities report that the at-fault driver in this case is facing charges for operating a commercial motor vehicle while impaired or fatigued. He also allegedly lied to authorities about his duty status, and he was found to have been violating at least two time-related rules. Prosecutors believe the man may have been behind the wheel for a shocking 37 hours before causing the trucking accident.

The accident occurred on Jan. 27, when the veteran employee was assisting a disabled 18-wheeler on the Reagan Memorial Tollway. The driver of a second semi-truck smashed into the vehicles on the roadside. The 39-year-old decedent perished in the trucking accident, and a 38-year-old state trooper was critically injured. The crash occurred even though all of the vehicles had moved into the right-hand lanes and shoulder of the road to promote safety. Emergency lights were also activated.

Official reports show that the decedent was the first Illinois Tollway employee fatality in 11 years. The wrongful death suit argues that the victim died because the truck driver was so fatigued that he could not safely operate his vehicle. Further, the truck company is accused of negligence because of poor oversight in the case.
