Family members of a woman who died because of physician error during an abortion procedure at Planned Parenthood in Illinois will receive $2 million through a settlement for their civil claim. The family members had brought a wrongful death suit against the reproductive health organization. Pro-life groups do not believe that the settlement is adequate, however, characterizing the settlement as “hush money.”
A pro-life law group had filed a legal complaint with an Illinois government agency in February 2013, asking for an investigation into the death of the 24-year-old woman. That victim died because of a fatal accident that occurred during a late-term abortion at a clinic in Chicago in July 2012. The law group alleged that Planned Parenthood did not take appropriate steps to treat the woman after the medical procedure took a turn for the worse. The pro-life group claimed that the woman did not receive proper medical care at the clinic, and they also argued that clinic staff did not provide complete information to the hospital after the woman was transferred.
Pro-life groups have taken a strong stance because of the wrongful death claim, alleging that abortion clinics in Illinois are often overlooked by regulatory agencies. Outpatient surgical facilities should all be subject to the same regulations, they argue. News reports have not said how many people perish every year because of botched procedures at other outpatient surgical clinics, however. Patients at every type of outpatient facility — not just abortion clinics — deserve to feel safe and receive appropriate treatment.
Every medical patient deserves to receive care that is appropriate and timely, no matter what their physical ailment. When physicians fail to provide that care, they may be held liable for medical malpractice. Family members may be eligible for receiving financial compensation for loss of companionship, pain and suffering and a variety of other claims. A consultation with an Illinois personal injury attorney may provide additional information.
