The Law Offices of Mathys & Schneid filed a lawsuit on behalf of a family who suffered the wrongful death of their two children during a truck accident in downstate Illinois on November 3, 2013. There were two trucks involved in the truck accident.
The lawsuit filed in Cook County alleges that the truck driven by Javier Matute was rolling slowly on the right shoulder of I-57 in Effingham, Illinois, when it suddenly and without warning pulled into the right hand lane directly in front of our clients’ truck. Our clients, Matei and Alina Tomoiaga, were riding in the sleeper truck along with their three children ages 8, 5, and 1. The lawsuit alleges that when the Matute truck suddenly pulled in front of our clients, our client who was driving took evasive action but was unable to avoid striking the trailer in front of him.
The crash caused catastrophic damage to our clients’ truck and caused two of the children to be ejected. We filed the lawsuit to recover for the wrongful death of the two children and the personal injuries sustained by our clients.
The accident reconstruction and vehicle inspections are ongoing, but preliminary information shows that Matute’s truck was going substantially slower than Tomoiaga’s and supports the theory that Matute suddenly pulled from the shoulder directly in front of Tomoiaga.
