Retention pond where Naperville child died was not fenced

A child who wandered into a pond near his Naperville home was pronounced dead, despite attempts by a witness, a police officer, a paramedic and hospital workers to revive the boy. An autopsy is likely to confirm the cause of death was due to drowning.

The 6-year-old lived in a home within 100 feet of an unfenced retention pond. A caller observed the boy's body floating face down in the water and called police.

Emergency personnel responded in force. Ten fire engines and nearly half a dozen ambulances were spotted at the scene. The person who contacted authorities had removed the child's body from the water and was trying to resuscitate the boy when a police officer arrived.

The investigation remains open as officials try to learn more about the child's activities leading up to the midday tragedy. Police will want to know who was caring for the child on that Saturday morning. Reports did not say when the boy's parents or caregiver arrived on the scene.

The immediate, natural concern is why the child was not monitored carefully near the water. Naperville officials may have to answer a second and perhaps more pertinent question: Why wasn't there a fence around the retention pond near a neighborhood where children lived and played?

Private and public swimming pool owners in Illinois must follow strict regulations to protect users and others from being harmed. Building codes specify how a pool must be enclosed and secured to prevent injuries and accidental drownings.

If you or a loved one have been injured due to inadequate security on someone's property or because of dangerous property conditions, contact an experienced Illinois personal injury attorney. These professionals can help you hold the owner of the property responsible through a civil lawsuit, such as a wrongful death claim.
