Could a civil suit be coming after Illinois motorcycle crash?

As the winter sets in across Chicagoland, motorcycles are probably not the first thing the minds of local residents. However, the memory of a deadly motorcycle accident is fresh on the minds of one Naperville family, since the motorist who caused the accident was recently given a criminal sentence.

An Illinois court recently made the decision to send a Will County man to prison for 10 years after he admitted to causing the death of a Naperville businessman last year. The 58-year-old businessman was riding his motorcycle when the other man collided with him. According to reports, the driver who hit the motorcyclist was intoxicated at the time of the accident.

Certainly, it must be a relief for the businessman's family that justice prevailed in criminal court, yet the outcome of the accident created an irreplaceable absence in their lives. This is where the ability to pursue a wrongful death claim comes into play.

No matter the time of year, it is the responsibility of drivers to be aware of their surroundings and make sure they are capable of driving. Oftentimes, motorcycles are harder to see than sedans or pickup trucks, so it's necessary to be on alert for these smaller vehicles at any time, not just the warm months of the year. Beyond that, drivers have a duty to make sure they are not intoxicated or too tired when they decide to get behind the wheel. While using a car is convenient to get from place to place, it can also become a dangerous tool if the driver does not adhere to their responsibility to act with reasonable care and caution.
