Aurora driver who fled fatal pedestrian crash gets jail

The defendant was two years younger when he made a decision that would land him in jail. The young Elmhurst man was driving in the dark two years ago and caused a fatal pedestrian accident. Rather than try to aid the critically injured pedestrian or wait for police or medical personnel to arrive, the driver fled the scene.

The victim was a 30-year-old Michigan resident who had been helping out a friend. The companion had run out of gas in the early morning hours of Dec. 12, 2010. The man who was struck and killed was walking back to the friend's car on eastbound Butterfield Road in Aurora.

According to court documents, the 23-year-old Elmhurst driver was headed home from work around 4:30 a.m. He hit a man from behind as the victim was walking along the roadside. The pedestrian would never recover from the neck and head injuries he received in the accident.

The driver apparently stopped at the accident scene for a brief time. According to the suspect's defense attorney, panic set in and caused the young man to flee.

Aurora police pieced together enough information to track the suspect to his home, where the driver was arrested two days after the fatal accident. A felony charge of failure to report a fatal accident and an unmet $150,000 bail put the Elmhurst man behind bars at the DuPage County Jail.

If an accident report confirms that the driver was negligent and careless, the family of the deceased victim may have the ability to file a wrongful death suit against the motorist. While no amount of money can bring back the man, the family should be compensated for any financial loss experienced in this tragedy as they cope with what has happened.
