Cars Put Pedestrians at Risk for Injury and Death

According to the National Highway Traffic Safety Administration, 4,092 pedestrians died in motor vehicle accidents in 2009. Just one year before that, 52 pedestrians died and 3,225 pedestrians were injured in the Chicago area alone.

Here are some more facts and figures about pedestrian accidents and injuries:

  • In 1998, 69,000 pedestrians were injured nationally
  • In 2009, that number dropped to 59,000
  • Pedestrians represent 10.9 percent of trips but over 12 percent of travel fatalities
  • 72 percent of the 2009 deaths occurred in urban areas
  • 48 percent of the these fatalities occurred on a Friday, Saturday or Sunday
  • 70 percent of them happened between 4:00 pm and 4:00 am

Vehicles can seriously injure pedestrians, even when they travel as slowly as 10 mph. Pedestrians injured by vehicles may be able to recover from the driver of the vehicle.

The most important factor commonly used to determine pedestrian recovery is whether the driver of the vehicle was negligent. An individual is considered negligent if they did not drive with a reasonable level of care and caution in the circumstances of the accident. If the driver of the vehicle is found negligent, a pedestrian may be able to recover damages:

  • Past medical expenses
  • Future medical expenses
  • Lost wages from work while taking time away to recover
  • Permanent loss of earning capacity caused by injuries
  • Pain and suffering

It is important to note that the laws for accidents involving negligence vary by state. In some states, pedestrian recovery may be reduced if the pedestrian also acted negligently and therefore held some responsibility for the occurrence of the accident.
